On September 24, 2008, Jason Shirley was scheduled to make an appearance for his re-trial after the first one ended in a mistrial in early June.

Problem is, Shirley didn't bother to show; remaining with the Cincinnati Bengals.

Now a Fresno County Superior Court judge issued a bench warrant Thursday morning -- that won't take effect until Tuesday morning. That means Shirley will be allowed to remain in Cincinnati until 8:30 a.m. Tuesday (September 30) before the Bench Warrant is in effect.

Like an arrest warrant, if Shirley doesn't show by Tuesday, the Bench Warrant commands Shirley's arrest.
